Surigao del Sur town denies permit to mining firm

July 19, 2010

By Tito N. Fiel

Philippine Daily Inquirer

Posted date: July 16, 2010

CANTILAN, Surigao del Sur, Philippines—Mayor Genito Guardo has denied the application of a mining company to extract nickel ore from this town, citing the need to protect the environment from possible destruction.

Guardo said he sent a letter to the company, named Marcventures and owned by Mindanao businessmen Mario Vijungco and Dy Chi Hing, on Thursday, informing its management of the decision to reject its mining permit application.

He said he would rather protect the environment than risk it in exchange for the economic benefits the mining operation would bring to the town.

Earlier, officials of this town also expressed dismay at Marcventures’ activities even if it had yet to acquire a permit.

“I and other officials, along with military and police representatives inspected the mining site and found out the company had already started extracting minerals even if it had no permit,” Guardo said.

But he clarified that the rejection of the mining permit was mainly based on the resolution of the town council, which expressed opposition to mining activities here.

Carl Ceasar Rebuta, project development officer of the Legal Rights and Natural Resources Center based in Cagayan de Oro City, said they were elated by the decision of officials to bar mining activities in the town.

Rebuta said anti-mining advocates had repeatedly warned that mining activities would compromise the watershed areas of the town.

Marcventures, which holds a mineral production sharing agreement covering 4,799 hectares here, had said it planned to extract 800,000 metric tons of nickel per year through the open-pit system.

But Guardo said he believes that the local government of Cantilan has enough power to bar Marcventures from operating despite its being an MPSA holder.

Cantilan people on the March

May 4, 2010

By Emma Hotchkiss, Carl Cesar Rebuta and Jaybee Garganera

It was exactly a year ago today, when local residents from Surigao del Sur vowed that they will never allow their exquisite hometowns to become another hapless victim of a crime against Mother Earth and nature. In celebration of the World Earth Day in 2009, more than a thousand folks from different sectors in the province joined a 3-kilometer march in the municipality of Cantilan to condemn mining operations in the area. These mining operations threaten the watersheds critical to the support of the province’s irrigation system, water supply and Cantilan’s proposed mini-hydro power project. Furthermore, the proposed mining sites infringe upon the indigenous peoples’ ancestral lands.

In an area that was declared as a Critical Watershed Forest Reserves by virtue of Presidential Proclamation 1747 signed by President Gloria Arroyo on March 23, 2009, it has been one long harrowing year, and there are very few reasons to celebrate Earth Day for 2010. From that simple people’s march, so much more struggles have been tendered and will continue to be offered.

Presidential Proclamation 1747, declared the portion of the public domain of Alamyo, Buyaan, Paniki Rivers and Sipangpang Falls situated in the Municipalities of Carascal, Cantilan and Madrid, Province of Surigao del Sur and in the Municipalities of Jabonga, Santiago and Cabadbaran, Province of Agusan del Norte as critical watershed forest reserves. At the same time, however, there are two approved Mineral Product Sharing Agreements (MPSAs)—Marcventures Mining and Development Corp. (MMDC) and Carac-an Development Corp. operating in the municipality of Cantilan and its neighbor towns, Madrid and Carrascal. Both MPSAs are located in the watersheds of the rivers that support their irrigation systems.

Alarm bell sounded over the opening of Caraga watershed reserves to mining & quarrying

By Caraga Watch | insidemindanao.com

SURIGAO DEL SUR—The Caraga Region is currently at the forefront of the Arroyo administration’s attention as a yet untapped source to fill and line its coffers, an inexhaustible milking cow for funds for electoral kitties and instrument for creating a rosy picture of our bankrupt economy.

The Mining Act of 1995, the Indigenous People’s Rights Law (IPRA) and its major implementing agency, the National Commission on Indigenous Peoples (NCIP) set the stage for the legalized depletion of our national patrimony. These government policies and agencies, together with the Local Government Units (LGU), the Department of Environment and Natural Resources (DENR) through its Mining and Geosciences Bureau and the Department of Energy (DOE), are being used to guarantee profits in mining and undermine the interests and unity of lumad communities.READ MORE>>>

Caraga lumads demand ouster of NCIP head

 BEN SERRANO, GMANews.TV

BUTUAN CITY - Members and officials of the Caraga Regional Tribal Consultative Assembly (CRTCA) will hold “peaceful” lightning protest rallies at the regional office of the National Commission on Indigenous People (NCIP) until Friday next week to demand, among others, the ouster of its regional director.

In an interview with GMANews.TV at the picket line, CRTCA regional chairman Datu Ebanta Evangelisto Morada, Jr. said the protest rallies, which began Tuesday, will last until February 5.

In their four-page demand, the indigenous people asked the Caraga regional offices of the NCIP and the Department of Environment and Natural Resources to investigate and conduct ocular inspections of the alleged illegal logging and mining activities in Mount Agutayan, Calamba; in Brgy. Puting Bato in Cabadbaran City in Agusan del Norte; in Brgy. Padiay in Sibagat town, Agusan del Sur; and in Kitcharao town, Agusan del Norte.

Datu Ampo of Surigao del Sur demanded a congressional inquiry and the cancellation of Presidential Proclamation No. 1747, which declared watershed areas inside their ancestral domains in the towns of Carrascal, Cantilan, Madrid, in Surigao del Sur province and in Jabonga, Santiago and Cabadbaran towns in Agusan del Norte.

LGUs non-compliant with waste management warned

January 26, 2010

By PHOEBE JEN INDINO
January 25, 2010, 5:07pm

CEBU CITY — The Environmental Management Bureau (EMB) of the Department of Environment and Natural Resources (DENR)’s Region 7 office is warning all concerned local government units (LGUs) to fast-track the implementation of their solid waste management program as the agency is now in the process of finalizing the list of candidates for the final notice pursuant to Republic Act (RA) 9003, or the Ecological Solid Waste Management Act.

It can be recalled that the National Solid Waste Management Commission (NSWMC) Secretariat sent a list of candidates for the 3rd strike policy as early as September 30, 2009 to the EMB7 for confirmation.

Earlier, Eddie Llamedo, DENR7 Information Officer explained that the 3rd strike notice is the final warning issued by the NSWMC for those non-compliant with Section 37 as mandated under RA 9003.

“These notices will be addressed to local government units (LGU) in the region that have failed to fully implement the mandates of RA 9003,” he stressed.

Section 37 of RA 9003 provides that “no open dumpsites shall be established and operated, nor any practice or disposal of solid waste by any person including LGUs, which constitute the use of open dumps for solid waste, be allowed after the effectivity of this Act: provided, that within three years after the effectivity of this Act, every LGU shall convert its open dumps into controlled dumps, in accordance with the guidelines set in Section 41 of this Act (and) provided further, that no controlled dumps shall be allowed five years following the effectivity of (said) Act.”

Garbage crisis looms in Cantilan

CANTILAN – A garbage crisis looms in this town of 30,000 as the municipal dump in Magasang was ordered closed by the barangay council after its repeated demands to the town government to build a promised recycling facility fell on deaf ears.

The Barangay Council of Magasang issued the notice of closure after the municipal government , sources said, reneged on its promise to build a Material Recovery Facility (MRF) in the open dump located along the Magasang-Consuelo road.

As a result of the closure of the eight-year-old dump , the scheduled daily rounds of the town’s garbage truck have lately been erratic , forcing Cantilangnons to bury or burn their trash in their own backyards.

The situation worsened , sources said, during the Christmas break , when garbage collection halted for days. READ FULL STORY>>>

THE GOVERNMENT expects the value of mineral production to increase by 10%-20% this year, compared to the 39% rise recorded in 2009, the chief of the Mines and Geosciences Bureau said last week.

“I think [mineral production value] will be better [over the 2009 amount] because of new mines. If only a 10% increase, we can do it,” Mines bureau Director Horacio C. Ramos told reporters. READ FULL STORY>>>

5 mining projects on stream in Q1

businessmirror.com.ph

Written by Jennifer A. Ng | Monday, 04 January 2010 21:32

AT least five mining projects will come on stream in the first quarter of 2010 with a combined investments of $185 million, a senior official of the Mines and Geosciences Bureau (MGB) said on Monday.

“These are not ‘big-ticket’ projects but they are significant, as they will contribute to the projected increase in minerals production for [2010],” the official told reporters in an interview on Monday.

One cement production project owned by San Miguel Corp.’s Ramon Ang and four direct ore-shipping projects will operate within January to March this year.

Eagle Cement Corp., which will put up a facility in Akle in San Idelfonso, Bulacan, could spend as much as $160 million for the project. The project is targeting to service areas north of Manila. A company official earlier revealed that Eagle Cement is eyeing the provinces of Nueva Ecija and Nueva Vizcaya.

The cement plant is expected to produce 1.5 million metric tons (MMT) of cement, or about 35.2 million bags yearly. The plant’s daily output is expected to reach 4,000 MT, or around 100,000 bags of cement.

Four mining firms, meanwhile, are eyeing to go into direct shipping of nickel ore. These are Century Peak Nickel Corp., Oriental Synergy, Marc Ventures Mining and Development Corp., and the mining cooperative based in Surigao del Norte, the Minahang Bayan ng Mamamayan sa Dinagat Island.

Century Peak Nickel Corp. will spend as much as $10 million. The company has the capacity to ship out 1 MMT of nickel annually. Oriental Synergy’s Surigao Nickel project, which has a capacity to ship out 1.8 MMT of nickel annually, will spend about $6 million.

Marc Ventures Mining and Development Corp. has an annual output of 1.2 MMT of nickel and is investing $4.5 million for its venture. Minahang Bayan ng Mamamayan sa Dinagat Island has already spent $4 million in its bid to ship out 1 MMT of nickel annually.

Recently, MGB projected a 20-percent increase in the minerals production value in 2010. Mining officials said the agency has yet to finalize the year-end report but could safely project a 20-percent increase in the value of minerals production.

URGENT CALL FOR MASSIVE ACTION AGAINST THE MOA EXECUTED BY AJO.NET & MARCVENTURES MINING

December 26, 2009

DEAR ALL CARCANMADCARLANONS

Let us flood AJO.net Holdings Inc. with information and hard facts about MMDC, our long standing opposition against mining in Cantilan, illegal/invalid assignment of mining right (from VTC to MMDC), absence of permit from the local sanggunians (the provincial board and the sangguniang bayans of Carrascal, Cantilan and Madrid and business permit, opposition of the NIA on the ground that the area covered by the MPSA of marcventure is within the existing national and communal irrigation systems, e.g. cantilan irrigation system, buyaan communal irrigation system (madrid), panikian communal irrigation sysem (carrascal) and cantilan-cabas-an communal irrigation system (cantilan), the proximity of the mining production area is only 4 kilometers from the main dam/intake tunnel of NIA-Catilan Irrigation System which apparently will pose threat/damage to the existing irrigation system and food security, false statements contained in the Environmental Work Program - silent about the existing irrigation systems, dams and irrigated areas in violation of pertinent provisions of the Philippine Mining Act of 1995 (RA 7942), and the restriction provided in par. II (10) of the Environmental Clearance Certificate (ECC) which manifestly mandate that: “The proponent  SHALL DELINEATE AND EXCLUDE from its mining operations ALL AREA within its MPSA, THAT ARE DECLARED AS WATERSHED FOREST RESERVE. The total mining area of MMDC (4,799 has.) is within the Proclaimed Watershed Forest Reserve covered by Proclamation 1747 signed by Pres. Gloria Macapagal-Arroyo on March 23, 2009. Also, we inform AJO.net Holdings Inc. that a case for the cancellation of the MPSA is now pending at the Office of the Secretary, DENR, Diliman, QC.
